I'm no lawyer, but i think that prosecution for minor cannabis crimes is unlikely now. The law makes arrangements to expunge criminal records for minor weed offenses, so it seems like those types of prosecutions going forward would be moot. If we have any lawyers present I'd like to hear a professional take on it.
 
No lawyer here, but if they arrest and prosecute you for a legal substance… growing it yourself with no legal way to obtain it legally in ny, sounds like nys is promoting black market. I am growing less than what they say is legal for one adult to grow personally… and there are 2 adults in my house so legally 12 plants. With no dispensary in place to legally obtain it it seems like a catch 22. Also I am a land surveyor, there are many many people growing that didn’t before. And many more plants than legal! On another aspect, nys law states I can be in possession of 3 oz personally… where the hell am I going with 3 oz that I am going to use by myself. Duh! Nys is promoting sales and illegally grown weed! So if the old rules still apply, you have to travel to a legal state and smuggle it across the border… breaking federal law! I’ll grow within the legal limits set in place with the new laws and take my chances with the state. And why would they spend the money to prosecute me when it would instantly be expunged from my record with no monetary benefit to them. I will use logic and common sense… and continue the same as I was. I grew when it wasn’t legal, I will continue to do so. If they get me, it’s not like they can pressure me for the “bigger fish” cuz I am that guy. Also I know what goes into my product. I’ve heard stories from dispensary growers. They don’t care about quality just quantity. Prerolls in dispensary are scrap from trimming… not actual flower. Massive chemicals used with no flush, non organic. Sorry, going off on a tangent.
 
I agree with both. Grow away as long as your keeping to the soon to be law what can they really do.
2 dispensaries have opened outside Massena on the reservation and business is booming. Besides selling the usual weed, edibles, supplies you can also purchase plants. Price varies on the high of the plant.
I would love to open one but cant imagine the red tap you would have to go through. Worse than opening a liquor store or selling firearms I'd imagine.
 
Just remember, reservations are sovereign areas not under nys law. If they were assholes, which they are... They could bust you coming off the res which would be under transporting contraband from a federally protected land to state. Still not gonna buy weed from a dispensary! Now oils, extracts,concentrates are another thing. They have to go through stringent testing for food and drug admin for consumption. And they have the equipment to do it better than I can. So yes, I'll buy concentrates from a dispensary.... When one opens near me!

Yes, NORML is one of the sites asserting no current penalty. They do note that the changes in the law "will take effect in 2022" and offer no further explanation as to how that applies currently.

The state OCM only says that growing "is not allowed currently" but says nothing of existing penalties:


Just to clarify, the law says that the new cultivation requirements kick in no later than 18 months after the first dispensary sale (not counting those on reservation lands). We still don't have the rules yet, because we don't even have the rule-making board yet, and they can only sell NY-grown product, so dispensaries are at least a year off, more likely two.
 
While the NY Office of Cannabis Management gradually clarifies the many issues related to legalization, I can already walk to the corner store and buy weed or THC gummies over the counter. Apparently the storekeepers are betting on not being prosecuted.

I see that there's an accelerated timeline for medical home-growers. I could easily qualify, but I don't think I want to be registered:
"Home cultivation for certified patients has an accelerated timeline, but is not authorized until the OCM issues
regulations, which will occur on or before September 30, 2021."

Good Point I'm retired 20 years diagnosed with PTSD,
I can't even get a shotgun /Rifle permit been trying for the longest !
 
There is no harvest police saying you cant take a bud ,quick dry it and have a crafty tester:smokeit::thumbsup:
OK The results are in decided to a put a bud on my fios Tv box, turned her a couple times throughout the night,
long story short she broke up nice rolled and burned the way she should, The high was surprisingly nice, I Smoked a half a joint.
The only thing is that the high only lasted about a 1/2 hour , Why is that because I didn't Cure The bud yet or Maybe I cut her down to early.
