When can you call a strain yours, if ever?

They say that because it is very hard to find the original cuts.. Seeds from an elite cut aren't the same as the original cut itself. Old heads are say in the original cut is hard to find. You can find NL genetics in all kinds of strains, as well as by itsself.. But try to find a true NL cut numbered 1-5... NL5 being most popular.. That's not happening at our level, lol. Even if a seed bank has the elite cut of a strain.. Your just getting seeds from that plant.. mabey s1's.. Maybe an outcross.. But neither one is the same as having the elite cut. That's what they mean by hard to find.

I have a Ruby x Stone Dragon.

I'm lead to believe Ruby is a SD pheno with a cross of somthing else @HashMaster was it you that knows the other line? Cinderella99?

Anyhoo, looking to find a male in my Ruby x SD then pollenate a Mohan Ram Auto. This puts White back in but offers structure and size as well as heavy indica. I'll probably loose color but hopefully keep density and speed.

From there I'll be selfing until I can get somewhere close to full autofem and the desired traits of all 3 contributer's!

I'll let you know how I'm doing in a few years! lol!

Trademarks and copyrights are already being issued based on genetic profiling, its now a race to create a public domain genetics database to prevent strain patents.

Ownership, in the sense of having commanding intellectual rights for plants, usually through gov't-granted patents, has become near impossible to obtain just about everywhere in recent years. From what I understand, patents for whole plants, whether developed using genetic engineering or not, are essentially no longer being granted. And If not patented, nobody 'owns' exclusive commercial rights (what patents enforce) - anybody can replicate and (re)sell the seeds (and rename the strain too).

Ownership of, intellectual property rights concerning plant strain names would involve trademarks. Once fully legalized (in the U.S.), I presume the gov't will start issuing trademarks for cannabis strains.

So, there are few, if any, legally-enforceable ownership or naming rights concerning cannabis strains. Anyone can replicate seed and make up and commercially use new names for cannabis strains. With cannabis illegal, what else (non-regulation) would you expect? But I think it's the same with all plants.
 
I've noticed a lot of the polyhybrid f1s aren't as tough as real worked strains. Like I've noticed my C99 crosses are a lot tougher than my TGA crosses. Like moving forward, I don't think I'll use f1s in projects unless they're being worked to f2 haha. Maybe if it's some fancy clone only.

Copyright has no relevance at all to cannabis strain or plant 'ownership' or strain names. Copyright protects complex intellectual works, such as books and software, and their content from blatant copying. Copyright protection only applies to publishing/disclosure of that information, does nothing to protect from anyone using the information, such as using 'copyright protected' published gene sequence data to genetically clone and sell that strain.

Trademarks only protect a name/phrase/imagery used to describe a commercial product or service, generally only within a defined field/industry sector. Trademarks need to be new, all your own, and in in the U.S. meet standards of “lawful use in commerce.” I don't think the U.S. trademark office is actually granting trademarks for cannabis (illegal) products. For example, who has the granted trademarks for popular strains such as Girl Scout Cookies, Gorilla Glue, Jack Herer, etc.; and why aren't these being enforced? Some odds-ends of trademarks could be leaking through, not directly claiming cannabis or granted by bureaucratic incompetence.

Bottom Line: At least in the U.S., there is no government-supported/legal options (patents, trademarks, copyright) for 'ownership' of (actually, legal rights to exclude others from using) cannabis strain identity; strain/seed names; or most everything related to whole plants and their breeding. Any discussion of 'ownership' or 'naming' rights concerning strain names is rather meaningless, with only individuals' honor, professional ethics, and sense of right-wrong involved (totally subjective; no consensus/agreement ever likely).

Especially since I don't think he can enforce that, unless he has the name copy righted but even that is grey. But even then you could call the f2 something else, and he couldn't do anything. I worked for a company that made people sign all types of stuff they couldn't enforce haha.

Names are in the public domain - simply belong to nobody, meaning a total free-for-all, nobody gets to impose restrictions on others. Anybody can (re)name any 'strain' or 'plant" any time and any thing they want.

It seems there are 2 aspects being discussed. Answering the question/topic (When can you call a strain yours, if ever?), the answer in my view stated above and simple; and other more complex ethical issues among breeders, mostly seemingly involving some seeking to restrict others from (re)using specific names, or crazily (no basis) trying to restrict (re)use of 'their' seeds for breeding.
 
Come across a canadian site and buddy is using Joint doctors loryder#2 and crossing with stuff from Sweet seeds and Fastbuds and calling them what ever and selling them lol Says hes working with a bunch of Mepisto strains too :nono:
