Dutch Passion Trademarks

<If you have any significant relevant evidence of prior use, depending on country, 3rd parties can or can't easily challenge granted trademarks. In the U.S., aren't trademark decisions disclosed for 6-months public comment prior to granting? Any breeder wanting AutoDuck for itself simply should have commercially used that name before Dutch Passion did and left some retrievable evidence of this, and that alone would have killed granting of the trademark to Dutch Passion. >

I can't speak to the failure of google, but if you did a search on AFN, and other sites populated by MJ growers, you would find discussions going back years. ( try both autoduck and auto duck in the search. Don't ask me why, but that is the way the AFN search works best). Bonobo created the autoduck years ago...I want to say 2009. It has been commercially available in a couple of places. Other versions have been created several others, including CannedAbyss and Tobe, and more. If I can trademark anything that has been created by others, then why not take any MJ name, slap"AUTO" in front of it or behind it, and I can kidnap others MJ names.

Again, I have the utmost respect To Dutch Passion, their, growers, their breeders, and see no reason for them not to protect their intellectual property. However, it seems they to me, that they are putting their brand on other people's work as well.

We know that many other seed companies have used our genetics as the basis for their own breeding for years. We have a collection of regular seeds (15 varieties for less than 3% of our sales, its a service rather than a business) that are especially useful for professional and amateur breeders, and we know and accept that people use our genetics in this way.

We are quite happy for that to continue, but the one think we tend to request is that people don't use our genetics AND the name. Thats the only reason for the trademarks.
I fully agree with Tony. In this time were more and more countries start to legalize its good to save trademarks.
The only thing i dont like is save names like skunk white widow... because the names are used for a long time.
to the name Autoduck :
its used by members @AFN for a long time as i know right my friend @bonobo was the first who breed this strain and used the name. He didn't own the name but if he offer the seeds with this name DP has to accept this.
This is my opinion and if he do it in the future he has to talk with the owner of DP i think.

My idea is to make a database with strain names with a open license. But there has to be a community who support this and help to establish that.

We @AFN are a big family with good contact to different seed companys and i think we can start to do something like that together with the members hobby breeders and company's.

If there is interest to build something like that or any ideas lets make a new thread were we invite all the vendors for a open discussion.

And what about when you use others people genetics? You write about Destroyer that it comes from "Alberto". Is that true or that is someone else hard work? What about DJs BB?

ha, I will bow out! I am on probation but you bet I just saved a trip to the naughty step. (DP by way of monsanto with this ???)

The cost of a Trade Names here is $50. The Registry does a search if its not on the list you own it. I own like 20ish ™ companies have to purchase them from you then. Not all™ are international.
I wonder how many strains are straight up counterfeit exact clones in the Industry? So much for not saying a thing lol.:vibe:
 
Its a plant and no one invented anything. Patents and trademarks on plants is complete and utter horseshit! Many strain names have been around for ages but now its a damned goldrush to get them"trademarked'. It only matters who gets to the lawyer first, not who came up with it! Bonobo for example was breeding auto ducks LONG before DP but time and money wins. The little guy always loses.
Plant patents are even worse and now the floodgate is open! With the attitudes prevalent on Cannabis becoming an industry rather than just freeing it for our use, companies will start acting more like Monsanto in their rush for the almighty dollar and industry control. Don't think so? Look at California where commercial growers voted AGAINST recreational legalization! WHY??? MONEY and control, no other valid reason. Their are already rumbling and rumors of genetic engineering going on ( BC BUD?? ). Who do you think that will benefit, us? yeah right.

Nothing wrong with protecting intellectual property. I doubt a wee tm is any more likely to stop folk nicking it than a watermarked image though......canna growers seem to have even less repect for rules than soccer moms:rofl:
