Depends on your definition of the apes.
Do you mean apes as they exists in nature or imaginary, like the unicorn. The unicorn exists since it is a concept of the mind.

If imaginary, is the moral agency active?
It all comes down to the question "Is the ruling species rational beings?" If Yes, they are morally responsible. If not, no moral exists. It is a false statement to say an animal is evil. Humans can be evil, because of the moral agency.
